The Court of Appeal decision in Citi Cards Canada v Pleasance, 2011 ONCA 3 deals with the narrow issue of whether a financial institution is allowed to disclose mortgage balances to a judgment creditor. In concluding that the Personal Information Protection and Electronic Documents Act ("PIPEDA") bars such disclosure, the Court made important observations about PIPEDA that have significance more broadly than in the narrow context of judgment debtor collection issues.
First, the Court made clear that PIPEDA is a complete code and personal information ("information about an identifiable individual") can be disclosed only in accordance with consent of the individual or a specific exemption under s 7 of PIPEDA.
Second, the use of personal information is limited to intra-organizational purposes (absent an exemption). So, an organization collecting personal information can share that information widely within the organization -- provided the use is for purposes consistent with its collection -- but no sharing outside the organization is proper.
Finally, the Court's overall approach to PIPEDA was strictly to preserve the privacy rights of the individual. In the specific case, the individual was a debtor who owed money under a judgment. The individual was not especially sympathetic and appeared to have been uncooperative with collection efforts. Nevertheless, the Court sided with the individual; this suggests how seriously PIPEDA privacy rights will be taken by the Courts.

"Identifying himself as “Harry Mark,” the man asked Morton how much it would cost to retain him to collect a debt in Canada. Morton told him his hourly rate was $350, but he was willing to lower it to $275 after the would-be client suggested collecting from the debtor wouldn’t be difficult."
This is what makes me so fucking paranoid about these "progressives: we have here in Canada and all around the world.
James Morton is a Marxist who wants every person in the world to live under a global government who will tell us how to live and what is good for us.
Morton ans his friends will then and only then have their New World Order where everyone lives equally poor, with no nationalistic pride, open borders and a world currency.
Now, in reality I have to respect such a worldview.
But when Morton wants us sheep to live equally poor while he charges $350 an hour makes me furious.
Morton is a Globalist who looks at us "sheep" here in Canada as "world citizens", not "Canadians".
That is why Toronto is now referred to as a Global city in almost every newspaper.
When the people of Canada wake up to the complete and utter destruction of our country, we will have no one to blame but ourselves.
Pierre Trudeau said the following.........
1. In London England, January 13, 1969, Trudeau was asked by British students “What society would you like to make in Canada?” To which he replied: “Labour party socialist—or Cuban socialism or Chinese socialism-socialism from each according to his means.”
2. “There is no official [Canadian] culture” (October 8, 1971, speech to the House of Commons).
This Trudeau character is supposedly the best P.M Canada has ever had.
If that's the case and the people actually liked Trudeau and his worldview, then full blown Communism isn't far away.
How Mr Morton can charge people $350 an hour, live on the dole, and then want me to be poor is nothing short of a mental disorder.
Does Mr Morton spread his wealth around?
How much did Mr Morton give to charity last year?
Mr Morton is just like the politicians we have here in Canada.
They all make millionaire salaries, do nothing but "debate",and then they tell us all how to live, even though they never have.
When you can make millions of taxpayers dollars while preaching Karl Marx to the citizens of Canada, you have no choice to shake your head.
My head is ready to pop off but I have to go to work.
Yes Morton, work.
Not doing "deals" and skimming money off the top for yourself and your other lawyers.
I seem to be an expensive Marxist
