When does Ontario get the extra seats? Which election will it impact?

Your the lawyer and I am not. However, this would no doubt require new legislation to be put into effect.

Therefore don't hold your breath that it will be any time soon, and certainly not in the scenario where a non confidence vote occurs on the 27th of January, and the GG capitulates to Harper's preferred scenario of an election versus the GG's obligation to explore whether any other party can hold the confidence of Parliament (read: Coalition)

The new seats would be put in place as part of the normal cycle of the Electoral Boundaries Redistribution Act. When the results of the next census in 2010 is reported, it triggers a process which creates a Commission for each province and it takes a year and a half to two before the recommendations are passed by the House.

I don't think the 1990 census created new boundaries until the 1997 election and the 2000 until 2004. So depending on the election cycle, not until 2014ish.
