That point, however, does not imply an appeal to the Supreme Court is wrong.
Mr Khadr can return to Canada and an appeal proceed. The Federal Court of Appeal's decision raised a serious question as to the authority of the Courts to supervise the conduct of foreign affairs by the Federal Government. Such a significant matter ought to be considered by the Supreme Court so that the law is clear for the future.
Bring Khadr back, yes, but seek a ruling from the Supreme Court of Canada.

46. (1) Every one commits high treason who, in Canada,
(c) assists an enemy at war with Canada, or any armed forces against whom Canadian Forces are engaged in hostilities, whether or not a state of war exists between Canada and the country whose forces they are.

Why is Omar Khadr not being tried for treason?
He clearly violated the criminal code by fighting with the taliban while Canada was at war with the terrorist group.
I don't understand this.
How is this not treason, and why are the police not following the law by charging him with treason?
A lot of hypocracy on the Liberal blogs these days. Nothing waa done when the Liberals were in power but now its the Conservatives who are mean-spirited.
Funny.. I've never seen any court convict Khadr of anything, anonymous.
As for Larry.. yes, the Liberal government failed Khadr as well.. but that is no reason for the Conservatives to whine "they did it too!. Harper if anything has been worse on this issue.
Remember, Maher Arar was renditioned under a Liberal government too, but a Liberal government eventually realized a tragic mistake had been made and fought to get him back here. Meanwhile, if you check Hansard, you'll see folks like Stockwell Day and Harper were accusing the Liberals "of helping a terrorist".
If Maher Arar had been renditioned to Syria when Harper had been in power, I have no doubt he'd still be there.
Scott, the Liberals had a couple of years to do something. If had any intention of doing anything at all, they would have done it.
