Slow driving seldom amounts to Careless Driving

R v Cianchino (Quon JP) holds that, in general, where a driver on a major highway drives slowly because of mechanical problems that driver does not commit Careless Driving.

His Worship comments that should such driving continue for a lengthy period, with the driver ignoring potential turn offs, Careless Driving might be established.

The decision is lengthy and contains a detailed review of the law. It is not presently reported but I can scan a copy to anyone who needs it.
