Six months minimum for six plants

The Senate has passed Bill S-10 which imposes numerous mandatory minimums for various drug offences

The Bill reads, in part:

"(b) if the subject matter of the offence is cannabis (marihuana), is guilty of an indictable offence and liable to imprisonment for a term of not more than 14 years, and to a minimum punishment of

(i) imprisonment for a term of six months if the number of plants produced is less than 201 and more than five, and the production is for the purpose of trafficking."

I detest this Government. Every bill they introduce seems to have something to do with what appears to be their let's create a prison industry initiative. Canadians only have to look next door to see how that's turned out.

So 10 plants for personal as opposed to trafficing use would not invoke the minimum?

If true, does the crown have to prove trafficking or does the defense have to prove personal use and what is the definition of trafficking. Does trafficking include giving freely to friends?

We'll have to see if Ignatieff grows a spine this time the issue comes up in the House. If he really thinks opposing this bill is a big of an electoral risk for him hes every bit as clueless as I've always thought.

By my reading if you have 10 plants for personal use the mandatory does not kick in. Still, I remember university residences that were full of greenery and giving away marihuana is trafficking so ...

What is there's five really huge plants, vs. 6 small ones? What if there's 6 plants, but one is clearly dying? I don't get this. This is stupid. law = ass
