Canadian Wheat Board files lawsuit against federal government

I looked through the Act and could not see the basis to claim there is a requirement for a plebiscite -- perhaps I missed it?

The Canadian Wheat Board is launching a lawsuit against the federal government in an attempt to halt the Conservatives’ efforts to dismantle the wheat and barley marketing agency.

The CWB’s farmer-controlled board of directors argues that the government broke the law by tabling the Marketing Freedom for Grain Farmers Act (Bill C-18) before holding a plebiscite of affected farmers, as the Canadian Wheat Board Act requires.

“The Harper government has acted illegally and unethically in its attacks on the Canadian Wheat Board, and it must be stopped,” said board chair Allen Oberg, a farmer from Forestburg, Alta., in a statement. “As it charges ahead, the government is mowing down everything in its way. The casualties will be democracy, due process, Parliamentary debate and Canada’s agricultural economy.”
