It marijuana illegal?

The question seems trite except people often seem surprised to learn marijuana is illegal in Canada.

To be specific, possession of marijuana even for personal use is (absent a licence for medical use) illegal and a criminal offence.

Conviction for simple possession of 30 grams or less of marijuana is punished by up to 6 months in prison and a $1,000 fine; if possession is more than 30 grams the maximum prison is five years less a day.

In practice the usual punishment for possession of marijuana is far less than the maximum but such a conviction can lead to difficulty in the job market and may have the effect of excluding you from entry to foreign countries (most notably the United States).

Seeing have widespread the use of marijuana is (the Leader of our Provincial PC Party admitted using the drug) the continued criminal prohibition is problematic. That said, marijuana remains illegal -- possession is a criminal offence.

Agreed and I think we should go a step further. Like unreasonably low speed limits that are broken by 99% of drivers, laws that are not routinely enforced or enforceable should be changed. If they aren't changed, I think a constitutional argument could be made that random enforcement of laws is a breach of legal rights.

Yes, decriminalization of small amounts of marijuana seems commonsensical at this point. The maintenance of these laws just seems antiquated today. But in today's political atmosphere a change seems likely to come in the foreseeable future. I guess when we consider how long it took for the anti-slavery forces to outlaw slavery in all British colonies and protectorates, the slow change of pace is not surprising.

Re: Omnibus Crime Bill

Does it make passing a joint an act of trafficking? My friend, a criminal lawyer, was discussing this on the weekend. More specifically has the amount of drug been removed from the definition of trafficking?

Yes i agree possession of marijuana charged as criminal offense for personal use. Don't do things that are illegal.
