As you may know, the victim surcharge will be:
(1) 30% of any fine imposed; or
(2) if no fine imposed, $100 for summary conviction offences or $200 for indictable offences.
Bill C-37, now the Increasing Offenders' Accountability for Victims Act removes the Judge's discretion to impose the victim surcharge.

It is my understanding that in past this could be waived if it was deemed to be a hardship. Is this still teh case or will prisoners families be expected to pay?
