Reasonableness of verdict

R v Jacobs, 2014 ABCA 172:

[14]           A reviewing court considering the reasonableness of a trial judge's verdict must determine whether a properly instructed trier of fact could have, on the whole of the evidence, reached the same verdict: R v Yebes1987 CanLII 17 (SCC), [1987] 2 SCR 168 at paras 23-25, R v Biniaris2000 SCC 15 (CanLII), 2000 SCC 15 at para 36, 2000 SCC 15 (CanLII), [2000] 1 SCR 381; R v Martel2011 ABCA 114 (CanLII), 2011 ABCA 114 at para 16, 502 AR 200; R v Saddleback,2013 ABCA 250 (CanLII), 2013 ABCA 250 at para 13, 556 AR 17. This authorizes a limited reweighing of the evidence to assess the verdict's reasonableness in light of the evidence.
