I was protesting outside city hall in fort erie on Monday. i was protesting a by law that was going to be passed that night. I am known around the town hall as a participant in town hall council meetings. I have made presentations numerous times.

I started my protest outside city hall around 5:10 pm and never went inside, I was using a megaphone and nobody came in our out of the building and i never talked to anybody during the protest. All of a sudden the police show up and tell i have to leave, here is the video.

Here is the case law speaking to this issue.

Do I have a charter challenge or even a lawsuit for false arrest seeing how the officer told me " you have to leave for no reason", and he knew it was public property and i was doing a protest yet he still made me leave. when the sergeant came he uncuffed me a told i could stay but not use the megaphone. so clearly he didn't think the trespass notice was relevant.

The town is trying to BAN ME FROM ONE YEAR FROM THE WHOLE PROPERTY.

Can they do that based on the case law above?
