Bail pending appeal

In order to get bail pending appeal an accused must show, among other things, that the appeal is not hopeless.  The Court recently described what must be show as follows in R v Charles, 2014 SKCA 121:

[7]        The threshold that Mr. Charles must meet is not high. He does not have to show that he will be successful on the appeal, he need only show that the appeal is not frivolous: see R v Switucka2009 SKCA 115 (CanLII)337 Sask R 218[Switucka].
