Imprisonment following ex parte Provincial Offences Trial constitutional

R. v. Jenkins, 2010 ONCA 278 holds that s. 54(1)(a) of the Provincial Offences Act, which permits ex parte trials even in circumstances where there is a possibility of incarceration, is constitutional and does not violate s. 7 or s. 11(d) of the Charter?

Not one mention of the B.C. Motor Vehicle Act reference in there. I expect this will be appealed to the SCC.
