More on Black and Skilling (Enron)

The bottom line is that the honest services requirements have been cut back to relate only to bribes and kickbacks. The Court finds that the legislation, interpreted more broadly, was too vague and was uncertain. In both Black and Skilling there was no suggestion of bribes or kickbacks and so the convictions had to be set aside and new trials ordered.
